1. registration:
a) Course registrations and the resulting obligations are only effective for the studio owner after receipt of the agreed payment. Payments can be made by bank transfer or in cash. The registration form must be handed over to the trainer at the first lesson, otherwise the registration will not be valid.
b) All training appointments must be canceled at least 24 hours in advance by telephone (mailbox), by WhatsApp to 08247-9988802, by e-mail to info@pura-pilates.de and for group courses via the appointment portal. If no cancellation is made in good time, the full fee will still be charged.
2. course hours / conditions of course participation:
a) In the case of cards entitling the holder to participate in 8 units, the courses must be attended within 10 weeks of purchasing the card; in the case of cards entitling the holder to participate in 4 units, within 5 weeks of purchasing the card. After expiry of these deadlines, the cards become invalid and no longer entitle the holder to participate in the courses.
b) If, in the case of so-called course blocks (course blocks start and end on a fixed start and end date), a course is started by the participant(s)in - If a course is not attended for whatever reason, there is no entitlement to make up the missed course. After consultation, missed lessons that have been canceled at least 24 hours in advance can be made up for in the current course program as a gesture of goodwill. If it is a hybrid course, the course will be recorded and will be available online for 1 week. However, there is no legal entitlement to make-up or online provision - these offers are based entirely on goodwill.
c) In the event of serious illness or pregnancy, the amount will be refunded pro rata. A serious illness within the meaning of these conditions is deemed to exist if the participant is physically unable to carry out the exercises performed during the course, for example due to inpatient treatment in a hospital or a bone fracture.
d) In the event of an epidemic/pandemic, the units will be continued in the online livestream under the same conditions. If participation in online lessons is not possible or desired, the remaining units must be continued immediately after reopening; the validity will be extended accordingly.
e) A training session is 55 minutes long.
f) The lessons are conducted by the studio owner to the best of her knowledge and belief.
g) The participant undertakes to inform the studio owner of any existing injury, illness or other complaints or pregnancy before the start of the training session. Whether participation in the courses and lessons is compatible with the respective physical and mental condition is to be decided by each participant - despite this obligation to notify the owner - on her/his own responsibility; prior consultation with a doctor is recommended. In this respect, i.e. with regard to health suitability, the studio owner is not obliged to provide any information.
h) It should be noted that participation in the training sessions is not a substitute for medical treatment, but constitutes preventive measures or training under expert guidance.
i) For safety reasons and to protect the equipment, only training clothing that cannot cause damage to the equipment, such as clothing without zippers or buttons, is to be worn during lessons. Jewelry and watches must be removed before the course begins.
j) Participation in the operator's services under the influence of alcohol or narcotics is strictly prohibited.
k) Access to the studio is not permitted in the case of infectious diseases. The participant must stay away from the course in the event of such an illness.
l) Existing hygiene regulations and measures (e.g. in the event of a pandemic) must be complied with.
m) The operator reserves the right to exclude participants who violate the above obligations from participation; the claim to remuneration remains in force in the event of such justified exclusion.
3. opening hours
Opening hours are 15 minutes before and after each course and private lesson.
4. absence due to illness or vacation
A planned course unit may be canceled due to illness or vacation of the trainer. If this is the case, the participants will be informed in good time and the lesson will be made up for or the validity of the tickets will be extended accordingly
5. liability
a) The Studio Owner shall be liable in cases of intent or gross negligence on the part of the Studio Owner or a representative or vicarious agent and in the event of culpable injury to life, limb or health in accordance with the statutory provisions. In cases of gross negligence, however, the liability of the Studio Owner shall be limited to the foreseeable damage typical of the contract, unless another of the exceptional cases listed in p. 1 or p. 3 of this letter (a) applies at the same time. Otherwise, the Studio Owner shall only be liable under the Product Liability Act, for the culpable breach of cardinal obligations (cardinal obligations are obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely) or insofar as the seller has fraudulently concealed the defect or has assumed a guarantee for the quality of the delivery item. However, the claim for damages for the breach of material contractual obligations is limited to the foreseeable damage typical for the contract, unless another of the exceptional cases listed in sentence 1 or sentence 3 of this letter (a) applies at the same time.
b) The provisions of the above letter (a) shall apply to all claims for damages (in particular for damages in addition to performance and damages in lieu of performance), irrespective of the legal grounds, in particular due to defects, breach of duties arising from the contractual obligation or tort. They also apply to claims for compensation for futile expenditure. Liability for default shall be governed by the statutory provisions.
c) A change in the burden of proof to the detriment of the participant is not associated with the above provisions.
